Terms and Conditions (T&C) / DISCLAIMER

1. Scope and Applicability

These Terms and Conditions apply to all services, programs, sessions, digital products and information provided by Viane Mandel, Wiesenstr. 19, 39576 Stendal (“Provider”) to clients (“Client”) via the website, online platforms or in person.

By accessing this website, booking, purchasing, or using any service, the Client agrees to these Terms and Conditions.

2. Nature of Services

The services offered include coaching, mentoring, personal development support and energetic or spiritual methods.

The Provider’s services:

  • are non-medical

  • are not psychotherapy

  • are not medical treatment

  • are not a substitute for professional medical, psychiatric, or psychological care

3. No Medical Diagnosis or Treatment

The Provider:

  • does not diagnose diseases or medical conditions

  • does not promise or guarantee healing, improvement or specific results

  • does not provide medical advice

  • does not interfere with medical treatments prescribed by licensed professionals

Clients are explicitly advised to consult a licensed medical doctor or healthcare professional for physical or mental health conditions.

4. Disclaimer Regarding Health and Results

Even if statements on the website, marketing materials, testimonials, or session content may suggest potential benefits or positive outcomes:

  • No guarantees of success, healing or improvement are given

  • Results vary from person to person

  • Any perceived improvement is the Client’s subjective experience

The Client accepts full responsibility for their physical, mental and emotional well-being before, during and after the services.

5. Client Responsibility

The Client confirms that:

  • they participate voluntarily

  • they are responsible for their own decisions, actions and outcomes

  • they will seek medical or psychological help when needed

  • they understand that energetic and coaching methods are complementary only

6. Exclusion of Liability

To the maximum extent permitted by law, the Provider shall not be liable for:

  • physical, psychological, emotional or financial consequences

  • unmet expectations

  • indirect or consequential damages

  • decisions made by the Client based on sessions or content

Liability for intent or gross negligence remains unaffected where legally mandatory.

7. Booking and Payment Terms

  • All prices are binding as stated at the time of booking

  • Payment is due in advance, unless explicitly agreed otherwise in writing

  • Services may be refused or suspended if payment is incomplete

Accepted payment methods and due dates are communicated during booking.

8. No Refund Policy

Unless mandatory consumer law applies:

  • Payments are non-refundable

  • Missed sessions are forfeited

  • Dissatisfaction or lack of perceived results does not entitle the Client to a refund

This applies in particular to:

  • coaching sessions

  • energetic healing sessions

  • programs and packages

  • digital products

9. Cancellation and Rescheduling

By the Client:

  • Cancellations must be made in writing

  • Short-notice cancellations (i.e. less than 24 hours) may be charged in full

  • Unused sessions expire after 4 weeks

By the Provider:

  • The Provider may reschedule sessions for valid reasons

  • If a session is cancelled by the Provider, it will be rescheduled or refunded

10. Right of Withdrawal (EU & Germany – Digital/Service Clause)

For EU consumers:

If services begin immediately after booking, the Client expressly agrees that:

  • the right of withdrawal expires once the service has begun

  • this applies especially to coaching and digital content

11. Protection Against Chargebacks and Payment Abuse

The Client agrees that:

  • chargebacks or payment disputes without valid legal reason constitute a breach of contract

  • outstanding payments may be pursued legally

  • additional costs caused by unjustified chargebacks may be charged to the Client

12. Intellectual Property

All materials, content, methods and session recordings remain the intellectual property of the Provider. Reproduction, sharing, or commercial use is prohibited without written consent.

13. Confidentiality

The Provider treats all client information confidentially, subject to legal obligations. Confidentiality does not apply where disclosure is required by law.

14. Governing Law and Jurisdiction

  • German law applies, excluding UN sales law

  • For Swiss clients, mandatory Swiss consumer protection rights remain unaffected

  • Place of jurisdiction: Stendal, Germany

15. Severability Clause

If any provision is invalid, the remaining provisions remain effective.

16. Amendments

The Provider reserves the right to amend these Terms and Conditions. The version valid at the time of booking applies.
